inform\u0103m cu amabilitate c\u0103, \u00een calitate de intermediar \u00een tranzac\u021biile imobiliare, <strong>AVASOLIS<\/strong> este o persoan\u0103 obligat\u0103 conform <strong>art. 4, pct. 18 din Legea privind m\u0103surile \u00eempotriva sp\u0103l\u0103rii banilor (ZMISP)<\/strong> \u0219i <strong>art. 9, alin. 2 din Legea privind m\u0103surile \u00eempotriva finan\u021b\u0103rii terorismului (LMFT)<\/strong>.<\/p>\n\n\n\n<p>Conform legilor citate, \u00eenainte de \u00eencheierea <strong>Contract de intermediere pentru cump\u0103rare-v\u00e2nzare de propriet\u0103\u021bi imobiliare, Acord de depozit de garan\u021bie<\/strong> \u0219i alte documente, precum \u0219i la <strong>tranzac\u021bii de \u00eenchiriere a propriet\u0103\u021bilor imobiliare<\/strong>, \u00een care chiria lunar\u0103 se ridic\u0103 la sau dep\u0103\u0219e\u0219te <strong>10 000 euro<\/strong> sau echivalentul lor \u00een alt\u0103 valut\u0103, <strong>suntem obliga\u021bi s\u0103 efectu\u0103m o verificare complex\u0103, care include identificarea clien\u021bilor<\/strong>\u00cen acest scop, vom solicita urm\u0103toarele documente:<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Documente necesare<\/h4>\n\n\n\n<h5 class=\"wp-block-heading\">Pentru persoane fizice<\/h5>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Copie a unui document de identitate<\/strong>:\n<ul class=\"wp-block-list\">\n<li>Carte de identitate (pentru cet\u0103\u021benii bulgari)<\/li>\n\n\n\n<li>Pa\u0219aport (pentru cet\u0103\u021beni str\u0103ini)<\/li>\n\n\n\n<li>Document care atest\u0103 \u0219ederea cet\u0103\u021benilor str\u0103ini \u00een Bulgaria<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<h5 class=\"wp-block-heading\">Pentru persoane juridice<\/h5>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Copie a unui document de identitate<\/strong> reprezentantului legal \u0219i proprietarului(ilor) efectiv(i).<\/li>\n\n\n\n<li><strong>Copie a procurii<\/strong>, dac\u0103 o persoan\u0103, alta dec\u00e2t reprezentantul legal, v\u0103 reprezint\u0103, precum \u0219i o copie a actului de identitate al \u00eemputernicitului.<\/li>\n\n\n\n<li><strong>Declara\u021bie conform art. 42, alin. 2, pct. 2 din ZSPN<\/strong> \u2013 pentru o personalitate politic\u0103 proeminent\u0103, care verific\u0103 dac\u0103 clientul se \u00eencadreaz\u0103 \u00een categorii conform <strong>art. 36, alin. 2<\/strong> \u0219i <strong>art. 36, alin. 5<\/strong> la ZMIP.<\/li>\n\n\n\n<li><strong>Declara\u021bie conform art. 59, alin. 1, pct. 3 din ZSPN<\/strong> \u2013 pentru proprietarul real al capitalului unei persoane juridice (dac\u0103 nu a fost depus\u0103 o declara\u021bie conform <strong>art. 63, alin. 4<\/strong> \u00een Registrul Comer\u021bului sau proprietarii reali nu sunt \u00eenregistra\u021bi ca asocia\u021bi).<\/li>\n\n\n\n<li><strong>Declara\u021bie conform art. 66, alin. 2 din ZSPN<\/strong> \u2013 despre originea fondurilor la cump\u0103rarea unui imobil sau la \u00eenchirierea unui imobil cu valoarea chiriei lunare <strong>de sau peste 10 000 de euro<\/strong>.<\/li>\n\n\n\n<li><strong>Chestionar informativ<\/strong> \u2013 se completeaz\u0103 de clien\u021bi (persoane fizice sau juridice).<\/li>\n<\/ul>\n\n\n\n<h4 class=\"wp-block-heading\">Stocarea \u0219i prelucrarea documentelor<\/h4>\n\n\n\n<p>Documentele furnizate de dumneavoastr\u0103, precum \u0219i copii ale acestora, vor fi p\u0103strate \u00een mod corespunz\u0103tor \u0219i vor fi utilizate <strong>unic<\/strong> la efectuarea controalelor de c\u0103tre organele de stat competente, inclusiv <strong>Direc\u021bia \u201eInforma\u021bii financiare\u201c a Agen\u021biei de Stat \u201eSecuritate Na\u021bional\u0103\u201c<\/strong>.<\/p>\n\n\n\n<p>Prelucrarea datelor cu caracter personal \u00een scopul prevenirii <strong>sp\u0103larea banilor<\/strong> \u0219i <strong>finan\u021barea terorismului<\/strong> este considerat\u0103 o problem\u0103 de <strong>interes public<\/strong> conform <strong>Regulamentul (UE) 2016\/679<\/strong> \u0219i <strong>nu poate fi limitat<\/strong> din cerin\u021bele lui <strong>art. 12 \u2013 22<\/strong> \u0219i <strong>art. 34<\/strong> din acela\u0219i regulament (art. 83, alin. 2 din Legea privind sp\u0103larea banilor).<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Politica de protec\u021bie a datelor cu caracter personal<\/h4>\n\n\n\n<p>Pentru u\u0219urin\u021ba dumneavoastr\u0103, <strong>\u00een sec\u021biunea noastr\u0103 \u201ePolitica de protec\u021bie a datelor personale\u201c<\/strong> ve\u021bi g\u0103si informa\u021bii detaliate cu privire la:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Categoriile de date cu caracter personal pe care le prelucr\u0103m;<\/li>\n\n\n\n<li>Temeiurile juridice pentru prelucrarea datelor cu caracter personal;<\/li>\n\n\n\n<li>Categoriile destinatari;<\/li>\n\n\n\n<li>Termenele de stocare pentru fiecare scop de prelucrare.<\/li>\n<\/ul>\n\n\n\n<h4 class=\"wp-block-heading\">Identificarea legal\u0103 a clien\u021bilor<\/h4>\n\n\n\n<p>Conform <strong>art. 4 din ZMIP<\/strong>, toate persoanele obligate (institu\u021bii financiare, agen\u021bii imobiliare, notari \u0219i altele) <strong>sunt obliga\u021bi s\u0103-\u0219i identifice clien\u021bii<\/strong> prin prezentarea unui act de identitate oficial \u0219i luarea unei copii a acestuia (<strong>art. 53, alin. 1 din ZMIIP<\/strong>).<\/p>\n\n\n\n<p><strong>Pentru persoane fizice<\/strong>identificarea include <strong>clien\u021bi<\/strong>, <strong>reprezentan\u021bi legali<\/strong> \u0219i <strong>beneficiari reali<\/strong>.<\/p>\n\n\n\n<p><strong>Pentru persoane juridice<\/strong>pe l\u00e2ng\u0103 copii ale actelor de identitate, sunt necesare \u0219i <strong>documente accesibile public<\/strong> ca:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Situa\u021bia actual\u0103 a statutului companiei<\/strong><\/li>\n\n\n\n<li><strong>Statut actualizat sau contract de societate<\/strong><\/li>\n\n\n\n<li><strong>Referin\u021b\u0103 pentru proprietarii reali ai capitalului \u0219i reprezentan\u021bii societ\u0103\u021bii<\/strong><\/li>\n<\/ul>\n\n\n\n<h4 class=\"wp-block-heading\">\u00cencheierea de contracte la distan\u021b\u0103<\/h4>\n\n\n\n<p>La \u00eencheierea <strong>Contract de intermediere pentru v\u00e2nzare-cump\u0103rare<\/strong> \u0438\u043b\u0438 <strong>Acord privind depozitul de garan\u021bie<\/strong> prin <strong>declara\u021bie electronic\u0103, semn\u0103tur\u0103 electronic\u0103 sau alt\u0103 form\u0103<\/strong> f\u0103r\u0103 prezen\u021ba clientului, se pot solicita <strong>documente suplimentare<\/strong>pentru a asigura respectarea
