{"id":10933,"date":"2025-03-01T16:59:03","date_gmt":"2025-03-01T14:59:03","guid":{"rendered":"https:\/\/avasolis.com\/?page_id=10933"},"modified":"2025-03-01T17:00:46","modified_gmt":"2025-03-01T15:00:46","slug":"zmip","status":"publish","type":"page","link":"https:\/\/avasolis.com\/en\/zmip\/","title":{"rendered":"ZMIP"},"content":{"rendered":"<p>We would like to kindly inform you that as an intermediary in real estate transactions, <strong>AVASOLIS<\/strong> shall be liable under <strong>Article 4, item 18 of the Law on Measures against Money Laundering (AML)<\/strong> and <strong>Article 9(2) of the Law on Measures against Terrorist Financing (MLFT)<\/strong>.<\/p>\n\n\n\n<p>According to the cited laws, before the conclusion of the <strong>Real Estate Purchase and Sale Agency Agreement, Security Deposit Agreement<\/strong> and other documents, and in <strong>real estate lease transactions<\/strong>where the monthly rent is equal to or exceeds <strong>10 000 euros<\/strong> or their equivalent in a different currency, <strong>we are obliged to carry out due diligence, including identifying customers<\/strong>. For this purpose we will require the following documents:<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Documents required<\/h4>\n\n\n\n<h5 class=\"wp-block-heading\">For individuals<\/h5>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Copy of identity document<\/strong>:\n<ul class=\"wp-block-list\">\n<li>ID card (for Bulgarian citizens)<\/li>\n\n\n\n<li>Passport (for foreign citizens)<\/li>\n\n\n\n<li>Document certifying the residence of foreign nationals in Bulgaria<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<h5 class=\"wp-block-heading\">For legal entities<\/h5>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Copy of identity document<\/strong> the legal representative(s) and the beneficial owner(s).<\/li>\n\n\n\n<li><strong>Copy of power of attorney<\/strong>if a person other than the legal representative represents you, and a copy of the proxy's identification document.<\/li>\n\n\n\n<li><strong>Declaration under Article 42, paragraph 2, item 2 of the MIPA<\/strong> - for a prominent political figure, which certifies whether the client falls within the categories of <strong>Article 36, paragraph 2<\/strong> and <strong>Article 36, paragraph 5<\/strong> of the MIPA.<\/li>\n\n\n\n<li><strong>Declaration under Art. 59, par. 1(3) of the MLIP Act<\/strong> - for the beneficial owner of the capital of a legal person (if no declaration has been submitted under <strong>Article 63, paragraph 4<\/strong> in the Commercial Register or the beneficial owners are not registered as partners).<\/li>\n\n\n\n<li><strong>Declaration under Article 66, paragraph 2 of the MIPA<\/strong> - the origin of the funds when purchasing real estate or renting a property with a monthly rental value <strong>at or above EUR 10 000<\/strong>.<\/li>\n\n\n\n<li><strong>Information questionnaire<\/strong> - to be filled in by customers (natural or legal persons).<\/li>\n<\/ul>\n\n\n\n<h4 class=\"wp-block-heading\">Storage and processing of documents<\/h4>\n\n\n\n<p>The documents provided by you, as well as copies of the same, will be stored properly and will be used <strong>only<\/strong> when inspections are carried out by the competent state authorities, including <strong>Financial Intelligence Directorate of the State Agency \"National Security\"<\/strong>.<\/p>\n\n\n\n<p>The processing of personal data for the purposes of the prevention of <strong>money laundering<\/strong> and <strong>the financing of terrorism<\/strong> is considered to be a matter of <strong>public interest<\/strong> according to <strong>Regulation (EU) 2016\/679<\/strong> and <strong>cannot be limited<\/strong> from the requirements of <strong>Art. 12 -
